Terms of Service

1. Acceptance of Terms

By accessing or using the CreaticoAI Marketing Studio platform (the "Service") provided by PharmaVision Solutions d.o.o., you agree to these Terms of Service in their entirety. If you disagree with any part, do not use the Service.

2. Service Description

CreaticoAI is a SaaS social media management platform that includes AI content generation, post scheduling, analytics, team management, and other social media marketing tools.

3. User Account

• You must be at least 18 years old to use the Service
• You are responsible for keeping your password confidential
• Notify us immediately of any unauthorized access to your account
• One account may be used by one person (exception: team plans with multiple seats)

4. Acceptable Use

You may not:

• Violate laws or third-party rights
• Post spam, misleading, or false content
• Attempt unauthorized access to platform systems
• Use the Service to distribute malware
• Circumvent plan limitations (e.g., password sharing)
• Copy, modify, or distribute our software without permission

5. Content Rights

You retain all intellectual property rights to content you upload or create through the Service. By providing content to the Service, you grant us a limited, non-exclusive license to store and display that content solely for the purpose of providing the Service.

All AI-generated content created using our platform belongs to you, subject to the terms of the underlying AI model providers (Anthropic, OpenAI).

6. Payment and Subscription

• Subscriptions are billed in advance on a monthly or annual basis
• Prices are in USD, excluding VAT
• No refunds for partially used billing periods
• You may change your plan at any time; new pricing takes effect in the next billing cycle
• Late payment may result in temporary access restrictions

7. Cancellation and Termination

You may cancel your subscription at any time through account settings. Access to the Service remains active until the end of the paid period. We reserve the right to suspend or terminate accounts that violate these Terms.

8. Service Availability

We aim for 99.9% uptime but do not guarantee uninterrupted operation. Scheduled maintenance will be announced in advance when possible. We are not liable for damages caused by service unavailability.

9. Limitation of Liability

To the extent permitted by law, our total liability to you shall not exceed the amount you paid for the Service in the preceding 12 months. We are not liable for indirect, incidental, or consequential damages.

10. Changes to Terms

We may modify these Terms with at least 14 days' notice. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Croatia. The courts of the Republic of Croatia shall have jurisdiction over any disputes.

12. Referral Program

CreaticoAI offers a referral program that allows users to earn cash rewards by recommending new users.

• Reward: €5.00 per qualifying referral (see conditions below)
• Qualification: A referral qualifies when the referred user activates a paid subscription (PRO or BUSINESS) and keeps it active for at least 30 days without a refund
• Minimum payout: You may request a payout once your accumulated balance reaches €50.00
• Payout method: Bank transfer (IBAN) or PayPal, using the details provided at the time of request
• Processing time: Payout requests are processed within 3–5 business days of approval
• Self-referral: Using your own referral link to create fake or duplicate accounts is strictly prohibited
• Fraud: Suspicious activity (fake registrations, program abuse) may result in account termination and forfeiture of all pending rewards
• Program changes: We reserve the right to modify or discontinue the referral program with 14 days' notice; earned rewards remain valid
• Taxes: Users are responsible for declaring and paying any applicable taxes on earnings received through the referral program
